Can BOI and EEC exemption years be added together?
No, they don't add like that. The years on each side come from two separate rule sets: the EECO route's figure is a case-by-case ceiling, not something granted on filing; the BOI route has its own cumulative cap on years and its own cap on the exemption amount. More to the point, under the BOI announcement now in force, the same project may not claim duplicate incentives. Adding the two sets of years together is a common misreading in Chinese-language material.
01The two routes run under two different laws
"The EEC gets you a dozen-plus years of tax exemption" is a claim that circulates widely in Chinese-language material. It is not entirely without a source, but it loses the qualifications that matter most along the way, and what is left is an addition that does not actually work.
The EECO route runs under the Eastern Special Development Zone Act: you file an investment proposal, and the incentive review and negotiation committee, then the EEC Policy Committee, assess it on four dimensions — strategic, economic, environmental and social. The official wording is negotiation-based and tailor-made — settled case by case, not granted because you filed. The BOI route runs under the Investment Promotion Act: graded by activity category and A tier, with published conditions and a timetable you can plan around. The two rule sets each have their own basis for counting years and their own cap, and they do not sit on the same axis — so they cannot simply be added.
02No duplicate benefit on the same project
The boundary is drawn by a BOI amending announcement: where the EEC Policy Committee has already announced a grant of rights for a particular industrial promotional zone, operators in that zone may still apply for BOI promotion under the Investment Promotion Act, but may not apply for duplicate incentives on the same project. That clause replaced the earlier wording, and it is the direct test for whether the two can stack.
Running in parallel is not the same as stacking. The two routes can exist at the same time and be applied for separately, but the same incentive on the same project is not granted twice. When you hear "you can get both", the follow-up question is whether it is the same item, on the same project.
03The add-on is open only to the A tiers
This BOI measure for the EEC is open only to the A tiers; the B tiers are not covered. A number of categories are also named as excluded — deep-sea fishery, air transport, maritime transport and rail transport among them — with the full list being whatever the BOI Office's current announcement says. The add-on itself comes in two groups: capability and location, one item within each group, and the two groups stack. The capability group asks for an actual commitment — training cooperation or R&D spending, not a form filled in. The location group looks at which class of plot the plant lands on.
04So ask it this way instead
Don't ask "how many years does the EEC get me". Ask "what tier does my category grade at, which add-on group is open to me, and can I actually deliver on the commitment". The first question has no general answer; the second is the one you can actually put a number on. The specific years and amount cap need to be confirmed against the announcements in force and run against the project's own figures.
