Sending Chinese engineers to Thailand under BOI: visas and work permits

In short

Foreign staff of a promoted company have a dedicated fast-track route, with quotas and approvals looser than the ordinary process. But it carries hard deadlines — once a position is approved, the work permit application has to be filed within a set number of days, and the person's visa has to have enough validity left when the paperwork is done. Cut it fine and you start over.

01The promoted-company route is not the ordinary route

When a manufacturing project lands, deciding who to send is as important as building the plant. What promoted status gives you here is routinely underestimated — but the convenience comes with preconditions, and those are rarely spelled out at the point the certificate is issued. An ordinary foreign-owned company bringing in foreign staff works two queues in parallel: the work permit at the Ministry of Labour and the visa at the Immigration Bureau, each with its own waiting time, on top of the required ratio between foreign and local employees. A promoted company uses a different route — three competent authorities acting together, one submission and one approval process, with looser quotas, faster approval and longer terms on the positions granted.

For a project that has to have its production line standing within half a year, that difference is real money. It decides whether the equipment maker's engineers can be on site on schedule.

02Three deadlines people trip over

The route is faster, but it is unforgiving about dates. Three of them account for most of the damage.

One more gets missed regularly: a departure also has to be reported, and it has to be reported before the employment ends. Filing it after the person has already gone is the kind of history that surfaces in a company's second year.

03Renewal turns on whether last year was compliant

The first application usually goes through. The second year, at renewal, is where it shows. The core documents for renewal are the previous year's personal income tax payment receipt and the social security contribution record; for management positions you generally also have to be able to show what technology transfer has actually taken place.

What that rule means in practice: if the person's Thai salary has been declared low, or social security has not been paid the way it should be, renewal exposes it directly. Plenty of companies hold the declared base down to save cost in the current period and pay far more for it a year later at the renewal counter. 04What to do about short assignments

For commissioning, acceptance testing and emergency repairs there is a dedicated urgent temporary work permit route. It has a clear cap on days, and one person can normally use it only once.

Treating it as a standing method and using it again and again does not work. Its proper place is as a bridge until the formal work permit comes through.

05Put the people plan into the master schedule

The practical way to sequence it: as soon as the project decides to post people, put "who comes, for how long, on what status" into the master schedule alongside the construction plan. Long-term site staff go through the formal position application; short-term support uses the bridge route. Do not start on any of it after the tickets are booked.

How many positions your project should apply for, what qualifications and salary conditions each position calls for, whether your existing people's visa status meets the conditions for filing, and whether the renewal documents are complete — all of that has to be checked item by item against your organisation chart, your actual staffing plan and what has already been declared for the people you have.
