Six manufacturing categories lose the BOI land ownership privilege
BOI announcement ส.7/2568 ends the land ownership privilege that used to come with promotion for foreign-majority companies in six manufacturing categories, among them metal products, industrial chemicals and industrial plastics. Groups that meet the conditions on long-term, large-scale investment are exempted. The change applies to applications submitted from 1 September 2025.
01What it means for you
For a manufacturing project, check at the tier assessment stage whether the activity falls on the list, not later. If it does, the whole plan for acquiring land may have to change. Other categories, data centres among them, are not affected, so the rule cannot be applied across the board.
- Your business is manufacturing — metal products, industrial chemicals, industrial plastics or similar
- The project plans to buy land in the company's own name to build the plant
- The application is submitted after September 2025
If any one of these is true, your plan for buying land may be caught by the new rule. Check at the tier assessment stage whether your category falls on the list; if it does, the whole route to holding the site has to be re-planned. Other categories, data centres among them, are not affected, so the rule cannot be read as covering every project. It is worth having our advisers work through your own category line by line.
